What this amendment would do
SA 4350, submitted by Mr. Durbin, aims to change the Lead-Based Paint Poisoning Prevention Act by adding it to the bill H.R. 6644.
The purpose of this amendment is to add the following:
- Expanded Coverage: It adds tenant-based rental assistance under section 8(o) of the United States Housing Act of 1937 to the act.
- Child Safety Procedures: It adds new procedures for families with children under the age of 6 living in covered housing. This includes:
- Requiring the Secretary to create regulations that force owners of covered housing to conduct initial risk assessments for lead-based paint hazards.
- Specifying that a visual assessment is not enough to comply.
- Requiring owners to control identified lead-based paint hazards within 30 days and provide notice to residents.
- Setting specific timelines for these assessments based on the type of housing assistance provided.
- Exceptions: It establishes exceptions for risk assessments if the owner provides documentation of a recent assessment, proof that lead-based paint is not present, or provides the family with a different unit that has no hazards.
- Emergency Relocation: It requires regulations allowing families with children under 6 to relocate on an emergency basis—without penalties or waitlists—if lead-based paint hazards are identified but not controlled. They may move to a unit built in 1978 or later, or covered housing with no lead-based paint hazards.
