What this amendment would do
MR. MARSHALL submitted an amendment, known as the Violence Against Women by Illegal Aliens Act, to be added to the bill S. 5.
The purpose of this amendment is to change immigration rules by adding new rules regarding inadmissibility and deportability for certain crimes. Specifically, it aims to add the following to the law:
- Make any alien inadmissible who has been convicted of, admits to committing, or admits to acts constituting a sex offense or a conspiracy to commit a sex offense.
- Make any alien inadmissible who has been convicted of, admits to committing, or admits to acts constituting domestic violence, stalking, child abuse, child neglect, child abandonment, or violating certain protection orders.
- Make any alien deportable who has been convicted of a sex offense or a conspiracy to commit a sex offense.
- Update the definition of domestic violence under deportability rules to include any crime that constitutes domestic violence regardless of whether the jurisdiction receives grant funding under a specific Act.
- Allow the Secretary of Homeland Security to keep the discretion to not deport an alien for humanitarian purposes, to preserve family unity, or if otherwise in the public interest.
