What this amendment would do

SA 4296 is an amendment proposed by Mr. Graham to H.R. 7147. Its purpose is to add a new section to the United States Code titled Obstruction of immigration laws by official interference.

This amendment aims to make it unlawful for a responsible executive official of a State or unit of local government to knowingly restrict, limit, or prohibit compliance with formal requests from the Department of Homeland Security for reasonable advance notice (at least 48 hours, unless impossible) before a criminal alien is released.

The amendment adds specific penalties for officials who violate this law based on the type of crime the released alien was charged with or convicted of:

  • Murder, rape, or sex offenses against a minor: Fines and/or imprisonment between 10 and 25 years.

  • Serious violent felonies: Fines and/or imprisonment between 5 and 10 years.

  • Any other Federal or State criminal offense: Fines and/or imprisonment between 30 days and 6 months.
