S.Amdt. 4275

SA 4275, also known as the Safeguard American Voter Eligibility Act or the SAVE America Act, aims to change the requirements for registering and voting in Federal elections to ensure only United States citizens participate.

The amendment seeks to add the following changes to the bill:

• Voter Registration Requirements: It requires applicants to provide documentary proof of United States citizenship to register for Federal office. This includes documents like a valid U.S. passport, REAL ID compliant identification, or specific government-issued photo IDs.

• Verification Processes: It mandates that States verify citizenship status and establishes a process for those without documentary proof to provide an attestation under penalty of perjury and other evidence. It also requires States to identify non-citizens using sources like the Department of Homeland Security (SAVE system) or the Social Security Administration.

• Voting Requirements: It requires every individual voting in a Federal election to present an eligible photo identification document. For in-person voting, this must be a tangible document. For absentee voting, a copy of the ID must be included with both the request and the submission of the ballot.

• Accountability and Penalties: It creates a private right of action for violations and establishes criminal penalties for election officials who register applicants who fail to present documentary proof of citizenship, as well as for executive branch employees who provide material assistance to non-citizens attempting to register or vote.

• Administrative Duties: It requires the Secretary of Homeland Security to notify State election officials when an individual becomes a naturalized citizen and directs the Election Assistance Commission to provide implementation guidance.
