What this amendment would do
SA 4133, submitted by Ms. Klobuchar, aims to add a new section called PART PP--CIVIL LAW ENFORCEMENT TASK GRANTS to Title I of the Omnibus Crime Control and Safe Streets Act of 1968.
The purpose of this amendment is to allow the Attorney General to provide grants to State, local, Tribal, or territorial law enforcement agencies to hire retired law enforcement personnel. These retired personnel would be used to:
- Train civilian employees on tasks that can be performed for a law enforcement agency.
- Perform civilian law enforcement tasks, which include things like forensics analysis, reviewing camera footage, and assisting in investigations for carjackings, homicides, and financial crimes.
The amendment clarifies that these tasks do not include the power to use force or make arrests.
To keep officials accountable, the amendment adds several requirements:
- Hiring Checks: Agencies must make a good faith effort to check the disciplinary and internal investigation records of retired officers before hiring them.
- Audits: The Inspector General of the Department of Justice will conduct audits to stop waste, fraud, and abuse.
- Penalties: Entities with unresolved audit findings will be barred from receiving funds for two fiscal years.
- Reporting: The Attorney General must provide annual certifications on audits and exclusions, and report any instances where an applicant received multiple grants for similar purposes.
