What this amendment would do

SA 4120, submitted by Ms. Hirono, aims to replace section 314 of division D in bill H.R. 4016.

The amendment seeks to change the bill by ensuring that funds cannot be used for the following:

  • Transferring or delegating Department of Education responsibilities to other Federal agencies if they were not already transferred or delegated before May 1, 2025.

  • Carrying out interagency agreements made on or after May 1, 2025, unless those agreements are substantially similar to ones that existed before that date.

Additionally, the amendment adds that the Department of Education must maintain the staffing levels needed to handle its statutory responsibilities, programs, projects, and activities in an effective and timely way.
