What this amendment would do
SA 4114, submitted by Mr. Schumer, is an amendment to bill H.R. 4016, which covers appropriations for the Department of Defense for the fiscal year ending September 30, 2026.
The purpose of this amendment is to stop the Department of Justice from using funds to approve or facilitate claims under the Federal Tort Claims Act that would result in a personal payment or settlement for the personal benefit of the President.
The amendment adds the following points to the bill:
- It notes that the Department of Justice is responsible for protecting the financial and legal interests of the U.S. when settling claims.
- It states that President Trump filed two claims in 2023 regarding the FBI search of Mar-a-Lago and investigations into Russian interference in the 2016 election.
- It asserts that using taxpayer dollars to pay the President at his own order goes against the system of checks and balances.
- It claims that the Deputy Attorney General and the Assistant Attorney General in charge of the Civil Division lack objectivity because they previously represented the President or others in his political orbit.
