What this amendment would do
SA 4107, submitted by Mr. Bennet, aims to add a section to the bill H.R. 4016 that prevents the use of funds by the Central Intelligence Agency, the Department of Defense, and other U.S. intelligence or paramilitary entities to provide materiel support to any group of individuals for the purpose of overthrowing the regime of Venezuelan leader Nicolas Maduro.
This amendment seeks to ensure that no such support—whether direct or indirect—occurs without authorization from Congress. This prohibition stays in place unless Congress repeals it via a joint resolution or the President provides a report justifying the support and Congress subsequently approves it.
The amendment specifies that materiel support includes:
- Military equipment, advice, and training.
- Intelligence and counterintelligence advice, information, and guidance.
- Planning, execution, and logistics for military, paramilitary, or intelligence operations.
- Actions that would cause death or serious bodily harm to Venezuela's leadership.
- Communications equipment and related training.
The amendment does not prohibit activities solely for the following purposes:
- Defending against armed attacks by the National Armed Forces of Venezuela.
- Collecting and sharing intelligence on threats from Venezuela.
- Supporting diplomatic efforts to return wrongfully detained U.S. citizens.
- Disrupting the production and distribution of illicit narcotics from or through Venezuela bound for the U.S.
- Countering the activities of North Korea, Iran, China, or Russia in Venezuela or neighboring states.
