What this amendment would do

SA 4077, submitted by Mr. Warnock, is an amendment to bill H.R. 4016, which deals with appropriations for the Department of Defense for the fiscal year ending September 30, 2026.

The purpose of this amendment is to prohibit the use of funds from the Act to allow certain officials to perform the duties of an immigration officer.

Specifically, it aims to stop the following from performing functions granted to the Department of Homeland Security under the Immigration and Nationality Act:

  • Law enforcement officials of the United States Marshals Service.
  • The Drug Enforcement Administration.
  • The Bureau of Alcohol, Tobacco, Firearms and Explosives.
  • The Federal Bureau of Prisons.
  • Any other Department of Justice employee designated by the January 22, 2025 Memorandum from Acting Attorney General Bejamine C. Huffman.
