What this amendment would do

SA 4059, submitted by Ms. Rosen, aims to add a section to bill H.R. 4016 regarding the classification of the Nevada Test and Training Range as a location where contamination occurred and military members were exposed to toxic substances.

The amendment proposes the following changes and additions:

  • Classification: It requires the Secretary of Defense to classify the Nevada Test and Training Range as a location where contamination occurred.

  • Identification of Personnel: It directs the Secretary of the Air Force to create a process to identify current and former members of the Armed Forces stationed at the Nevada Test and Training Range since January 27, 1951.

  • Evidence and Documentation: The Secretary of the Air Force must allow members to provide documentation of their assignment, but must make all efforts to identify individuals without requiring them to submit evidence of their stationing.

  • Covered Locations: The Secretary of Defense must establish a process to identify members who were stationed at a covered location, which includes:

  • Facilities on the most recent list published in the Federal Register by the Department of Energy under the Energy Employees Occupational Illness Compensation Program Act of 2000.

  • Locations that are classified or data masked by the Department of Defense where there was or is potential exposure to toxic substances, such as from burn pits used for waste disposal.
