What this amendment would do

SA 4049 is an amendment proposed by Mr. Durbin and other senators to be added to bill H.R. 4016, which deals with appropriations for the Department of Defense for the fiscal year ending September 30, 2026.

The purpose of this amendment is to add Section 195, which aims to change how funds are handled for the Department of Transportation--Federal Transit Administration--Capital Investment Grants.

Specifically, the amendment seeks to ensure the following:

  • The Secretary of Transportation must make disbursements of obligations to recipients who have existing full funding grant agreements under sections 5309(d) and 5309(e) of title 49, United States Code, if the Secretary paused those disbursements on or after September 30, 2025.

  • These disbursements must be made when the recipient requests them.

  • The Secretary is prohibited from withholding disbursements because of the interim final rule titled "Disadvantaged Business Enterprise Program and Disadvantaged Business Enterprise in Airport Concessions Program Implementation Modifications" published on October 3, 2025.
