What this amendment would do

SA 4034, submitted by Mr. Merkley, is an amendment to bill H.R. 4016. This bill deals with appropriations for the Department of Defense for the fiscal year ending September 30, 2026, and other purposes.

The purpose of this amendment is to add a rescission limitation. It aims to change how funds are taken back by requiring that:

  • No amounts from this Act or any other appropriation Act for fiscal year 2026 can be rescinded.
  • Rescissions can only be made through an appropriation Act, as defined in section 3 of the Congressional Budget and Impoundment Control Act of 1974.
