What this amendment would do
SA 4026, submitted by Mrs. Shaheen, aims to change how funding is handled for state incentives regarding sexual assault survivors' rights and updates rules for evidence kits.
The amendment makes the following changes:
-
Funding for State Incentives: It changes Section 5903(a) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 to allow the Attorney General to increase formula grants for States based on three tiers:
- 60 percent of funds go to States with a law providing rights under section 3772 of title 18, United States Code.
- 25 percent of funds go to States with a combination of laws, regulations, practices, and policies providing those same rights.
- 15 percent of funds go to States with a combination of laws, regulations, practices, and policies providing rights that are substantially similar to section 3772 of title 18, United States Code.
- States can only receive an allocation from one of these three tiers.
-
Evidence Kit Preservation: It changes Section 3772(a)(2)(A) of title 18, United States Code, so that evidence kits must be kept for not less than 20 years.
-
Request Process: It changes Section 3772(a)(3) of title 18, United States Code, by replacing the requirement for a "written request" with just a "request" regarding the notification before disposal of evidence kits or further preservation.
