What this amendment would do

SA 3968, submitted by Mr. Sullivan, proposes the addition of "TITLE IV--STABILITY ACT OF 2025" to bill S. 3386. The amendment aims to make the following changes and additions:

Tax Credit Modifications

  • It extends and modifies enhanced premium tax credits for taxable years beginning after December 31, 2025, and before January 1, 2028.
  • It changes the household income limitation by substituting "600 percent" for "400 percent" for the specified years.
  • It adjusts premium assistance for taxpayers with household income less than 150 percent of the poverty line, setting the amount equal to monthly premiums reduced by $5.
  • It establishes specific premium percentages for taxpayers with household incomes between 400 and 600 percent for the year 2027.
  • It excludes health plans that offer coverage to aliens not lawfully present in the United States from the tax credit.

Agent and Broker Accountability

  • It allows for enforcement actions against "lead agents" (executives or individuals in leadership roles). These agents may be subject to civil money penalties or disqualified from serving as a lead agent in future agreements.
  • It allows the Secretary to terminate agreements with agents or brokers "for cause" based on a "preponderance of the evidence" if they violate regulations, agreement terms, or Federal and State laws.

Enrollment Verification

  • It requires Exchanges to check the Death Master File at least quarterly to identify deceased enrollees.
  • It mandates the disenrollment of deceased individuals in individual plans and requires the Exchange to contact the estate of deceased individuals in family plans to ensure other members remain enrolled.
  • It requires these disenrollments to be reported to the Secretary, who must provide an appeals process.
