What this amendment would do
Mr. Sullivan submitted SA 3967, which is titled the "Strengthening Transparency, Affordability, and Budget Integrity for Your Insurance Act of 2025" (or the "STABILITY Act of 2025"). This amendment aims to modify the bill S. 3385 by striking everything after the enacting clause and inserting new sections.
The amendment aims to change or add the following to the bill:
-
Premium Tax Credits: It extends and modifies enhanced premium tax credits for taxable years beginning after December 31, 2025. This includes:
- Changing household income limitations to substitute "600 percent" for "400 percent" for years 2026 and 2027.
- Adjusting premium assistance for taxpayers with household income less than 150 percent of the poverty line to equal monthly premiums reduced by $5.
- Setting specific premium percentages for taxpayers with household income between 400 percent and 600 percent for the year 2027.
- Excluding any health plan that offers coverage to aliens not lawfully present in the United States.
-
Agent and Broker Accountability: It adds rules for federal exchange agents and brokers, including:
- Allowing the Secretary to disqualify lead agents (executives or individuals in leadership roles) from future agreements and subject them to civil money penalties if an agent or broker fails to comply with requirements.
- Establishing that the Secretary may terminate agreements with agents or brokers for cause based on a "preponderance of the evidence" if they violate regulations, agreement terms, or Federal or State law.
-
Enrollment Verification: It requires Exchanges to check the Death Master File at least quarterly. If an individual is found to be deceased, the Exchange must:
- Disenroll the individual.
- For family plans, contact the estate to disenroll the deceased person while keeping other qualified individuals enrolled.
- Report these disenrollments to the Secretary, who must provide an appeals process.
