What this amendment would do
This amendment, submitted by Mr. Kennedy, aims to ensure there is no pay for members of congress during government shutdowns. It proposes adding a section to the bill that requires the reduction or withholding of pay for Members of Congress during a lapse in appropriations for one or more Federal agencies or departments.
Key Changes and Purpose
-
Pay Reductions: After the general election in November 2026, the payroll administrator for the House and Senate must exclude pay for each day a government shutdown is in effect.
-
Escrow Account: For shutdowns occurring between the date of enactment and the November 2026 election, pay for each day of a shutdown will be withheld and deposited into an escrow account.
-
Release of Funds: To comply with the 27th Amendment, any money held in escrow will be released to Members of Congress on the pay reduction effective date.
-
Administrative Support: The Secretary of the Treasury is tasked with providing necessary assistance to the payroll administrators to carry out these requirements.
