What this amendment would do
SA 3933, submitted by Mr. Kennedy, aims to add a section to bill S. 3012 titled "No Pay for Members of Congress During Government Shutdowns." The purpose of this amendment is to ensure that Members of Congress do not receive pay during a Government shutdown, which is defined as a lapse in appropriations for one or more Federal agencies or departments.
Changes and Additions
The amendment adds the following requirements:
-
Pay Reduction: For days occurring after the general election in November 2026, the payroll administrator for the Senate and the House of Representatives must exclude pay for each Member of Congress for every 24-hour period a Government shutdown is in effect.
-
Escrow Account: For shutdowns occurring between the date the Act is enacted and the November 2026 election, pay will be withheld and deposited into an escrow account.
-
Release of Funds: To comply with the 27th Amendment to the Constitution, any funds held in the escrow account will be released to the Members of Congress on the pay reduction effective date.
-
Administration: The Secretary of the Treasury is tasked with providing necessary assistance to the payroll administrators to carry out these requirements.
