What this amendment would do

SA 3916 is an amendment to bill S. 2144. Its purpose is to protect the private information of "at-risk individuals," which includes Members of Congress, their immediate family members, designated congressional employees, and former Members of Congress.

The amendment aims to add a section focused on Protecting Covered Information in Public Records. It changes the bill by adding the following rules:

  • Government Agencies: It allows at-risk individuals to request that government agencies mark their covered information as private. Agencies must remove such information from public content within 72 hours of a request.

  • Data Brokers: It makes it unlawful for data brokers to knowingly purchase or sell, license, or trade covered information of an at-risk individual.

  • Other Businesses: It prohibits people, businesses, or associations from publicly posting covered information on the internet if they receive a written request to stop. They must remove the information within 72 hours and are generally prohibited from transferring that information to others.

  • Covered Information: This includes private details such as home addresses, personal phone numbers, personal emails, social security numbers, driver's license numbers, bank account details, vehicle license plates, and information regarding the school or daycare attendance and routes of children under 18.

  • Exceptions: The amendment does not apply to information required by the Federal Election Commission, information filed to qualify as a candidate, news-gathering activities, or information the individual voluntarily publishes on the internet.

  • Redress: At-risk individuals can seek injunctive or declaratory relief in court if their covered information is made public in violation of this section.
