What this amendment would do

SA 3912, known as the Ending Improper Payments to Deceased People Act, aims to improve how Federal and State agencies work together with the Do Not Pay working system.

The amendment proposes the following changes:

  • It directs the Commissioner of Social Security to provide information to the agency operating the Do Not Pay working system to help prevent improper payments and recover benefits or payments that were paid improperly.

  • It requires the Commissioner of Social Security and the agency operating the Do Not Pay working system to create an agreement on how to share the costs of State death data.

  • It prevents the Commissioner of Social Security from recording a death for an individual unless there is clear and convincing evidence that the person should be presumed deceased.

  • It requires notification to be sent to any agency with a cooperative arrangement if an individual was incorrectly identified as deceased.

The changes in this amendment are set to take effect on December 27, 2026.
