What this amendment would do

SA 3428, submitted by Mr. Johnson, aims to add a section to H.R. 3944 titled "Limitation on Disclosure of Earmarks."

The purpose of this amendment is to stop Members of Congress from publicizing the congressional earmarks they requested and received. It does this by adding the following:

  • Definitions: It defines "congressional earmark" based on House rule XXI and defines "disclosure" as mentions in official office communications, debates of other bills, media appearances, public speaking, or campaign communications.

  • Penalty: If a Member of Congress discloses a congressional earmark outside of official debate of this Act in the House or Senate floor or Appropriations Committees, the funds for that earmark shall be rescinded.

  • Notification: The head of the Federal agency must notify the House and Senate Committees on Appropriations within 15 days after earmark funds are rescinded.

What Congress actually voted on

One recorded vote has been taken on this amendment.

  • The Senate: a vote on a proposed change to the billAmendment Rejected 21–75

A vote on one change, not on the bill. A bill can collect dozens of these, and losing one does not stop it.
