What this amendment would do
MR. WYDEN submitted amendment numbered SA 307 to set up a rule in the Senate regarding legislation that affects nursing homes.
Purpose and Changes
-
The amendment creates a point of order in the Senate against considering any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that meets specific criteria.
-
It aims to stop legislation that would reduce Medicare or Medicaid payments for nurses or certified nursing assistants in long-term care facilities.
-
It also aims to stop legislation that would modify existing requirements related to the number of nurses or certified nursing assistants in Medicare- and Medicaid-certified nursing facilities.
-
To get around this rule and pass such legislation anyway, the Senate would need an affirmative vote of three-fifths of the Members, duly chosen and sworn. That same three-fifths vote is required to sustain an appeal of the ruling of the Chair.
