What this amendment would do
Mr. Van Hollen submitted amendment SA 244 to the concurrent resolution setting forth the congressional budget for the United States Government.
The purpose of this amendment is to add a point of order against legislation that repeals the prescription drug negotiation provisions found in the Inflation Reduction Act.
Specifically, it makes it not in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would repeal the prescription drug negotiation program under part E of title XI of the Social Security Act.
How it Can Be Overridden
The amendment states that this point of order may only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
Additionally, an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, is required to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
