What this amendment would do
Mr. Reed submitted amendment SA 2252 to the bill S. 1582, which is about the regulation of payment stablecoins.
What It Aims to Change or Add
The amendment adds a new section called STANDARD OF REVIEW at the end of the bill.
It aims to require a reviewing court to defer to the reasonable or permissible interpretation of the statute by an agency under specific conditions.
This rule applies if the Act is silent or ambiguous about a term or provision, and a primary Federal payment stablecoin regulator has followed certain procedures, lawfully adjudicated a matter, or followed corresponding procedural provisions of the Act.
This deference applies regardless of the significance of the related agency action or a possible future agency action.
