What this amendment would do

This amendment requires the annual collection of energy consumption and power source information from data centers and cryptomining facilities, which are defined as covered facilities that have more than 100 kilowatts of installed information technology nameplate power.

It aims to add a new section to the Clean Air Act that establishes an emissions performance standard for these covered facilities. Under this standard, fees are assessed on electric utilities and facility owners for greenhouse gas emissions from electricity consumption that exceeds a regional baseline.

The amendment also sets up rules for how collected fee funds are used, including supporting the reporting program, lowering residential electricity consumer costs, and funding zero-carbon electricity generation and energy storage assets.
