What this amendment would do

The amendment is titled the "Strengthening Transparency and Obligations to Protect Children Suffering from Abuse and Mistreatment Act of 2025" or the "STOP CSAM Act of 2025". Its purpose is to protect child victims and witnesses in federal court, facilitate the payment of restitution, improve reporting requirements and accountability for tech companies regarding online child sexual exploitation, and expand civil remedies for victims.

The amendment aims to change or add the following to the bill:

  • Update definitions related to child abuse, exploitation, psychological abuse, and protected information in federal court proceedings.

  • Require video recordings of depositions and testimonies involving child victims and witnesses, and establish strict rules for protecting sensitive personal information from public disclosure.

  • Create mechanisms to appoint trustees or fiduciaries to hold restitution payments for minor, incapacitated, or foreign victims.

  • Update and strengthen reporting duties for tech companies and online service providers to report apparent child sexual abuse material and exploitation to the CyberTipline of NCMEC within 60 days.

  • Establish new criminal and civil penalties for online service providers that fail to comply with reporting or material preservation requirements, and require large tech platforms to submit detailed annual safety and transparency reports to the Attorney General and the FTC.

  • Create new criminal offenses and penalties for interactive computer service providers that intentionally host child pornography or knowingly promote or facilitate specific child sexual exploitation offenses.

  • Expand private rights of action and civil remedies allowing victims to sue interactive computer service providers and app stores for personal injuries resulting from the promotion, aiding and abetting, or hosting of child pornography and exploitation.
