What this amendment would do

Look, as folks working for you in Congress, we need to keep our elected officials accountable. Mr. Warner submitted an amendment, designated as SA 128, to the concurrent resolution S. Con. Res. 7 for the fiscal year 2025 budget.

What It Aims to Change or Add

This amendment adds a new point of order to the bill's rules. In plain English, it aims to stop the Senate from considering certain budget reconciliation bills, resolutions, amendments, or conference reports if specific federal laws are being broken.

Here is what it specifically targets:

  • An ongoing violation of section 1341 of title 31, United States Code, as determined by the Comptroller General.
  • Any employees being paid in violation of section 3103 of title 5, United States Code, which requires civil service employees to be paid only for services actually rendered in connection with and for the purposes of the appropriation for which the employee is paid.

If someone tries to push a reconciliation bill through while these violations are happening, any Senator can raise a point of order to stop it. To get around this rule and pass the bill anyway, it would take a three-fifths vote of the Senate members to waive it or to successfully appeal the Chair's ruling.
