What this amendment would do
Ms. Blunt Rochester proposed SA 1239 to the bill S. 331, which deals with how fentanyl-related substances are scheduled under the Controlled Substances Act.
The Purpose and Changes
The amendment adds a new section at the end of the bill called a contingent effective date.
- It delays the entire Act and its amendments from taking effect.
- The law cannot go into live action until the Secretary of Health and Human Services makes a specific certification.
- The Secretary must certify that the grant program for State and Tribal response to opioid use disorders (found under section 1003 of the 21st Century Cures Act) is funded at an adequate level.
- That adequate level is defined as not less than the amount made available for such program for fiscal year 2024.
- This funding must be enough to address the incidence of opioid use disorder in all 50 States and the District of Columbia.
