What this amendment would do

As your legislative analyst, let us break down what this amendment is all about in plain English. Ms. Rosen submitted SA 1216 to the congressional budget resolution for fiscal year 2025 through 2034.

Purpose and Changes

The main purpose of this amendment is to hold our officials accountable by creating a new point of order in the Senate. This rule is designed to stop any bill, resolution, motion, amendment, or conference report that would increase the cost of prescription drugs.

Specifically, it aims to protect everyday people by targeting actions that would:

  • Repeal the $35 insulin cap for Medicare beneficiaries.
  • Increase out-of-pocket costs for Medicare beneficiaries.
  • Increase drug costs for Medicaid patients.
  • Increase drug costs for patients with private health insurance.
  • Increase drug costs for patients covered by TRICARE.
  • Increase drug costs for uninsured patients.

If someone tries to push a measure that breaks this rule, it takes a three-fifths vote of the Senate to waive or suspend the rule, or to sustain an appeal of the Chair's ruling.
