What this amendment would do
Mr. Warner submitted this amendment to the congressional budget resolution for fiscal year 2025. Common sense tells us we need to keep a close eye on how our government operates, and this amendment is all about hitting the brakes on certain major budget bills under specific legal circumstances.
What It Aims to Change or Add
-
Point of Order: The amendment adds a new rule to the Senate. It states that it will not be in order in the Senate to consider a reconciliation bill, a reconciliation resolution, or related items like amendments and conference reports, during any time that there is pending litigation against the President or another Federal officer alleging a violation of specific sections of title 5 of the United States Code (sections 1202 or 1211).
-
Waiver and Appeal Rules: This new rule can only be waived, suspended, or have its ruling sustained by an affirmative vote of three-fifths of the sworn Senators.
