What this amendment would do

What the Amendment is About:

  • Ms. Warren submitted an amendment intended for the concurrent resolution setting forth the congressional budget for the United States Government.

  • The amendment aims to add a new point of order in the Senate against legislation that would disrupt the smooth-functioning of the mortgage market.

What it Aims to Change or Add:

  • It adds a rule that makes it out of order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would cut necessary funding for or otherwise prevent the Bureau of Consumer Financial Protection from calculating and publishing the Average Prime Offer Rate.

  • This Average Prime Offer Rate supports the functioning of the mortgage market.

  • The rule can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.

  • An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, is also required to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
