What this amendment would do

As your analyst, let us look at what this amendment is trying to do for the people. Submitted by Ms. Warren, this amendment creates a new rule in the Senate to hold our officials accountable when they consider legislation.

What It Aims to Add

  • The amendment adds a point of order in the Senate against any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report.

  • It targets legislation that would make it easier for giant corporations to charge Americans junk fees, which explicitly includes excessive overdraft or credit card late fees.

  • To get around this new rule and pass such legislation anyway, it would take a three-fifths affirmative vote of the Senators chosen and sworn to waive or suspend it, or to sustain an appeal of the ruling of the Chair.
