What this amendment would do

Mr. Heinrich submitted SA 102, which is a deficit-neutral reserve fund relating to acceptable proofs of United States citizenship for Tribal citizens.

The purpose of this amendment is to protect Tribal citizens from immigration enforcement efforts. It aims to add a section that allows the Chairman of the Committee on the Budget of the Senate to revise allocations, aggregates, and other appropriate levels, and make adjustments to the pay-as-you-go ledger for legislation that requires the Secretary of Homeland Security to take specific actions.

Specifically, the legislation must require the Secretary of Homeland Security to:

  • Consult with Indian Tribes.
  • Issue guidance to U.S. Immigration and Customs Enforcement and Indian Tribes on forms of Tribal identification that are acceptable proofs of United States citizenship.

These changes are allowed as long as the legislation does not increase the deficit over the total period of fiscal years 2025 through 2034.
