What this amendment would do

Mr. Hawley submitted SA 91, which is an amendment to the bill S. 5. Common sense tells us we need to keep track of what our elected officials are trying to change in the law.

Here is what the amendment aims to change or add:

  • It replaces the proposed matter with a specific list involving individuals who are charged with, arrested for, convicted of, admit having committed, or admit committing acts that constitute the essential elements of certain offenses.

  • The listed offenses include burglary, theft, larceny, shoplifting, assault of a law enforcement officer, a crime of domestic violence, a felony crime against a minor, or any crime that results in death or serious bodily injury to another person.

  • It redesignates paragraph (2) as paragraph (4).

  • It inserts new definitions after paragraph (1) for paragraph (1)(E).

  • It clarifies that terms like burglary, theft, larceny, shoplifting, assault of a law enforcement officer, felony, and serious bodily injury have the meanings given to them in the jurisdiction in which the acts occurred.

  • It defines the term crime of domestic violence by using the meaning given in section 237(a)(2)(E)(i).
