What this amendment would do
What it Changes or Adds
- Adds protections for victims of domestic violence or human trafficking.
- Exempts certain aliens from specific custody requirements if they are a victim or witness in an active domestic violence or human trafficking investigation, or make a credible claim of being a victim or witness.
- Outlines specific examples where the custody rules do not apply, such as when law enforcement informs the Secretary that the alien may be a victim and the charges were based on duress, force, fraud, coercion, or information from an abuser.
- Includes examples involving certifications, pending immigration relief petitions for being battered or subjected to extreme cruelty, or approval and pending petitions for T-visa relief.
- Includes an exception stating that the custody requirements will still apply if the Secretary determines the alien is a threat to public safety or national security.
