What this amendment would do
This amendment was submitted by Ms. Hirono to the bill S. 5. The purpose of the amendment is to add protections for victims of trafficking to the bill.
The amendment aims to change the bill by stating that specific custody requirements will not apply to an alien if they are a victim or witness in an active human trafficking investigation, or if they make a credible claim of being a victim or witness to human trafficking.
The amendment also outlines specific examples where these custody rules do not apply, such as when law enforcement informs the Secretary that the alien may be a victim, when the arrest or charges were based on acts committed under duress, force, fraud, coercion, or information from a trafficker, or when the alien has been approved for relief or has a pending petition under section 101(a)(15)(T).
Finally, the amendment adds an exception stating that the custody rules will still apply if the Secretary determines the alien is a threat to public safety or national security.
