What this amendment would do
As folks looking out for the public and holding our officials accountable, we need to know what this amendment by Mr. Kelly proposes to add to the bill. The bill itself requires the Secretary of Homeland Security to take into custody certain aliens charged with theft in the United States.
This amendment adds two main rules to the bill:
-
Cooperation: The Secretary of Homeland Security must set up rules to cooperate with officials and court orders. This ensures that any alien in Department custody who needs to appear in court for another matter—like being a defendant, victim, witness, potential witness, or someone cooperating in a major criminal investigation—is transported or transferred by Department officers or employees to that court proceeding.
-
Release: If an alien is held in custody because of an arrest or charge and is acquitted or not convicted within 90 days after their first day of detention, they get the right to a hearing. At this hearing, they can challenge the basis for their custody or ask to be released.
