What this amendment would do
Mr. Blumenthal submitted SA 78 to the bill S. 5, which requires the Secretary of Homeland Security to take into custody aliens charged in the United States with theft.
Purpose of the Amendment
The purpose of this amendment is to establish detention priorities and permissive detentions when resources are limited. It aims to add a section called SEC. 4. DETENTION PRIORITIES to the end of the bill.
- If available Federal detention facilities or resources are not enough to house all required aliens, U.S. Immigration and Customs Enforcement must give higher priority to detaining aliens described in specific existing sections of the Immigration and Naturalization Act.
- U.S. Immigration and Customs Enforcement is allowed to detain aliens described in section 236(c)(1)(E) of the Immigration and Nationality Act only if there is enough detention space and personnel resources available.
