What this amendment would do
This amendment, submitted by Mr. Schmitt to the bill S. 5, focuses on giving State officials the power to hold federal officials accountable in court when federal immigration laws regarding the detention, release, and removal of aliens are violated.
Here is what the amendment aims to change and add to the bill:
-
It gives a State attorney general, or another authorized State officer, the right to bring a civil action in a U.S. district court against the Secretary of Homeland Security, the Attorney General, or the Secretary of State.
-
It allows these State lawsuits when a State or its residents experience or will experience harm—such as financial harm over $1 or an increased probability of future interactions with unlawfully present aliens—that is traceable to violations of federal detention, removal, visa discontinuation, or parole rules.
-
It requires U.S. district courts to advance and expedite these lawsuits on their dockets to the greatest extent practicable.
