What this amendment would do
Mr. Van Hollen submitted an amendment to the bill S. 5, which requires the Secretary of Homeland Security to take into custody aliens charged with theft in the United States.
Purpose and Changes
The amendment aims to add a waiver and reporting requirements to the bill. Here is what it does:
- Adds a waiver that allows the Secretary of Homeland Security or the Attorney General to waive the mandatory detention requirement if implementing it would divert resources away from catching, detaining, and removing aliens convicted of violent crimes.
- Requires the Secretary of Homeland Security or the Attorney General to conduct quarterly assessments to determine if resources are being diverted from dealing with violent criminals because of the mandatory detention requirement.
- Requires the Secretary of Homeland Security, in consultation with the Attorney General, to submit a report to Congress identifying any diverted resources within 90 days of the first date resources are diverted from deporting violent criminals.
