What this amendment would do
Mr. Merkley submitted the amendment to be proposed to the bill S. 5, which requires the Secretary of Homeland Security to take into custody aliens charged in the United States with theft.
The purpose of the amendment is to add a BEST INTEREST OF THE CHILD STANDARD at the end of the bill. It aims to change how noncitizen children younger than 18 years of age are handled by requiring the Secretary of Homeland Security to detain them in a manner that meets specific standards.
- Is consistent with the best interest of such noncitizen children
- Does not abrogate, modify, or replace protections for children in applicable Federal law, Federal regulations, court orders, or consent decrees
