What this amendment would do
Mr. Merkley submitted this amendment to the bill S. 5. The original bill requires the Secretary of Homeland Security to take certain noncitizens charged with theft into custody.
This amendment adds a requirement for a child custody determination hearing. If a parent or guardian who is 18 years of age or older remains in custody for 30 consecutive days and has a child younger than 17 years of age, the Secretary of Homeland Security must provide this hearing.
The purpose of the hearing is to determine whether it is in the best interests of the child for the noncitizen to be released to care for the child. Additionally, the Secretary can only determine a bond or other release conditions after deciding that the noncitizen does not pose a flight risk or a danger to the community.
