What this amendment would do

Mr. Murphy submitted this amendment to the bill S. 5, which deals with requiring the Secretary of Homeland Security to take certain aliens into custody. Folks down at the Capitol need to be held accountable for how these rules affect real people, and this amendment makes two specific changes to the bill.

What the Amendment Adds

  • Exemption for young children: It adds an exemption so that the mandatory detention requirement does not apply to children who are younger than 14 years of age.

  • Special Rule: It adds a rule stating that nothing in the Act or its amendments can be construed to supersede or modify the Stipulated Settlement Agreement filed in Reno v. Flores on January 17, 1997, or subsequent court decisions related to that agreement.
