What this amendment would do
Mr. Cassidy submitted this amendment to the bill S. 5, which deals with taking certain aliens into custody who have been charged with theft in the United States.
The purpose of this amendment is to expand reimbursements under the State Criminal Alien Assistance Program.
Specifically, the amendment aims to add and change the following in the law:
- It changes how compensation is calculated for the incarceration of certain prisoners by the Attorney General.
- It sets rules so that compensation for a specific undocumented criminal alien is provided for each day they are detained by a State or local subdivision, matching the average daily cost of incarceration at facilities in the same level of security for that State.
- It authorizes the appropriation of such sums as are necessary to the Secretary to carry out these changes.
- It updates the Immigration Reform and Control Act of 1986 to include additional aliens described in section 236(c)(E) of the Immigration and Nationality Act regarding reimbursements.
