What this amendment would do
- The amendment adds a new section to the bill called SEC. 4. ALTERNATIVES TO DETENTION FOR CERTAIN ALIENS.
- It requires the Secretary of Homeland Security to use ankle monitoring or a similar level of supervision instead of locking someone up, specifically for certain aliens who do not pose a threat to public safety and have extenuating circumstances.
Extenuating Circumstances and Procedures
- Extenuating circumstances include whether locking up the alien would result in the loss of a provider or caregiver for a child or dependent, or whether the alien is pregnant or suffering from a serious medical condition.
- The amendment requires the Secretary of Homeland Security, working with the Director of U.S. Immigration and Customs Enforcement, to set up procedures so these aliens can petition for alternative arrangements.
- It also requires the issuance of guidance to determine if an alien poses a threat to public safety.
