What this amendment would do
Mr. Tuberville submitted an amendment called the Border Safety and Security Act of 2025. It is designed to be added to a bill that requires the Secretary of Homeland Security to take certain individuals into custody. We need to keep our elected officials accountable, so let us look at common sense details of what this change aims to do.
What the amendment changes or adds
This amendment adds a new section to the end of the bill with the following rules:
- Gives the Secretary of Homeland Security the power to stop certain aliens from entering the United States at land or maritime borders if the Secretary decides it is necessary to achieve operational control over that border.
- Requires the Secretary of Homeland Security to stop the entry of certain aliens if the Secretary cannot detain them or place them in a specific program according to the Immigration and Nationality Act.
- Allows a State attorney general, or another authorized State officer, to bring a lawsuit against the Secretary of Homeland Security in a United States district court if there is a violation that affects their State or its residents.
