What this amendment would do
Mr. Murphy submitted SA 57 to be proposed to the bill S. 5. The purpose of this amendment is to strike out everything in the bill starting from page 3, line 9 through page 8, line 10, and replace it with a new section focused on enforcement by a State attorney general.
What it Aims to Change or Add
- Enforcement by Attorney General of a State: It allows a State attorney general, or another authorized State officer, to bring an action against the Secretary of Homeland Security in a U.S. district court on behalf of the State or its residents.
- Standing: This action can be brought if firearms shipped, transported, transferred, or otherwise disposed of to another person across the U.S. border—in or affecting interstate or foreign commerce—harms the State or its residents, allowing them to obtain appropriate injunctive relief.
- Disposition of Civil Action: Courts are required to advance the civil action on the docket and expedite its disposition to the greatest extent practicable.
- Harm Defined: A State or its residents are considered harmed if they experience harm, including financial harm exceeding $100.
