What this amendment would do
This amendment introduces the Clear Law Enforcement for Criminal Alien Removal Act of 2025, also known as the CLEAR Act. Its main purpose is to team up Federal immigration authorities with State and local law enforcement officers to help find, arrest, and hold individuals who are in the United States unlawfully or have violated immigration laws.
The amendment aims to add several key changes and requirements. It affirms that State and local police already have the inherent authority to enforce federal immigration laws during their routine duties. It encourages them to do so by taking away certain federal funds from any State or local government that passes rules preventing their officers from cooperating with federal immigration enforcement.
Additionally, the amendment requires immigration violation records to be added to the National Crime Information Center database, and forces State and local agencies to share specific information about apprehended individuals suspected of immigration violations with the Department of Homeland Security. It also mandates that the federal government build or acquire 20 new detention facilities, creates training manuals and pocket guides for local police, and provides legal immunity to State and local officers and agencies when they enforce federal immigration laws.
