What this amendment would do
Here is the straight talk on what this amendment is all about. Senator Duckworth put forward this proposal to keep tabs on folks going through the immigration system who have worn the uniform and served in the U.S. Armed Forces. As folks apply for immigration benefits or face enforcement proceedings, the folks at the Department of Homeland Security will have to check if that person currently serves or has served in the regular military, active reserves, or reserve components.
What It Changes and Adds
-
Identification: It forces the Secretary of Homeland Security to figure out if an immigrant applying for benefits or facing enforcement is a current or former member of the U.S. Armed Forces.
-
Record Keeping: It requires the Department of Homeland Security to mark those immigration and naturalization records to show the person's military service so the outcomes for these individuals can be tracked.
-
Protection: It puts a strict rule in place saying that any information gathered about their military service cannot be used to remove the person from the United States.
