What this amendment would do
What it Aims to Change or Add
As folks who vote for our officials, we need to keep a close eye on what gets added to our laws. Mr. Durbin, along with Mr. Blumenthal, submitted an amendment to the bill S. 5 to protect certain immigrants.
The amendment adds a section called Protection for Immigrants Brought to the United States as Children to the Immigration and Nationality Act.
Here is what it aims to do based strictly on the text:
- It states that a specific custody determination cannot be used as a basis to terminate a grant of deferred action under the June 15, 2012 Department of Homeland Security memorandum or the August 30, 2022 final rule known as Deferred Action for Childhood Arrivals.
- It ensures that aliens who meet the requirements for deferred action under that specific final rule will not be subject to certain custody paragraphs within the act.
- It clarifies that nothing in the amendment prevents the termination of deferred action for criminal conduct that would normally make an individual ineligible.
- It clarifies that nothing modifies requirements relating to enforcement for criminal conduct that would subject an alien to custody or removal under any other provision of the act.
