What this amendment would do
As an analyst keeping an eye out for everyday folks and holding our officials accountable, here is the straightforward breakdown of what is going on with this amendment submitted by Ms. Duckworth.
This amendment proposes changes to section 212(d)(5) of the Immigration and Nationality Act. Specifically, it allows the Secretary of Homeland Security to temporarily parole certain veterans back into the United States on a case-by-case basis.
To make sure we are keeping tabs on the rules, here is what the text says an individual needs to qualify:
- Must be a veteran as defined in section 101 of title 38, United States Code.
- Must seek parole to receive health care furnished by the Secretary of Veterans Affairs.
- Must be outside of the United States because they were ordered removed or voluntarily departed.
The text also notes that this parole is not an official admission into the country. Once the health care purpose is served, the veteran must return to the custody they were paroled from.
Finally, the amendment blocks parole for any veteran who is inadmissible due to a criminal conviction for a crime of violence or a crime that endangers national security, provided they served a prison term of at least 5 years for that crime.
